Welcome to H2OKitty. These Terms of Service govern your use of our website (https://h2okitty.com) and any purchases made through it. By accessing or using our website, you agree to be bound by these Terms.

1. Who we are

"We", "us" and "our" refer to H2OKitty, a trading name of Hyde Digital Ltd, a company registered in England and Wales (company number 16369212), registered address 167-169 Great Portland Street, London W1W 5PF, United Kingdom. "You" and "customer" refer to anyone accessing our website or buying our products. "Products" means the goods offered for sale on our website.

2. Your account

  • You must be at least 18 years old to create an account or place an order.
  • You agree to give accurate, current and complete information.
  • You are responsible for keeping your account details confidential and for all activity under your account.

3. Orders, prices and payment

  • All orders are subject to availability and to our acceptance. We may refuse or cancel an order, for example if a product is unavailable or we suspect fraud. If we cancel an order you have paid for, we will refund you in full.
  • Prices are shown in US dollars ($). Any applicable sales tax is calculated and shown at checkout.
  • If a product is listed at an obviously incorrect price because of an error, we will contact you before dispatch and you can choose to pay the correct price or cancel for a full refund.
  • Available payment methods are shown at checkout. By placing an order, you authorise us to charge the total amount shown.

4. Delivery

  • Shipping options, costs and estimated delivery times are shown at checkout and in our Shipping Policy.
  • Delivery times are estimates and are not guaranteed. Carrier or customs delays outside our control may affect delivery.
  • Risk of loss or damage passes to you when the goods are delivered to the address you gave us.

5. Our 365-Day Happy Cat Guarantee, warranty, returns and refunds

Our 365-Day Happy Cat Guarantee, our warranty and our refund terms are set out in our Refund Policy, which forms part of these Terms.

If you are a consumer in the UK, you also have a legal right to cancel within 14 days of receiving your order, as described in our Refund Policy. Nothing in these Terms affects your statutory rights.

6. Filter plan

If you add our optional filter plan, our Filter Plan Terms also apply and form part of these Terms. They explain billing, reminders and how to skip, pause or cancel at any time.

7. Using our products

Our fountains are for everyday pet drinking water. They are not veterinary products and are not intended to diagnose, treat, cure or prevent any condition. If your cat stops drinking, strains to pee or seems unwell, please talk to your vet.

  • Keep the pump fully under water while it's running, and keep the water level above the minimum line.
  • Change the filter every 2 weeks and clean the fountain as shown in the instructions.
  • Use the power adapter supplied. Keep the cable and plug away from water and out of reach of chewing pets.
  • Fill with tap or drinking water only. Don't add other liquids, cleaning products or supplements.
  • Always read the instructions in the box before use.

8. Reviews and content you send us

If you post a review or send us photos, you confirm the content is your own honest experience and give us permission to show it on our website and social media. We publish genuine reviews only and do not edit them to change their meaning.

9. Intellectual property

All content on this website, including text, images, logos and graphics, is owned by Hyde Digital Ltd, trading as H2OKitty, or its licensors. You may not use, copy or distribute it without our permission.

10. Limitation of liability

Nothing in these Terms limits or excludes liability where that is not permitted by law, including liability for death or personal injury caused by negligence, for fraud, or for breach of your statutory consumer rights. Subject to that, we are not liable for any indirect or consequential losses arising from your use of our website or products, and our total liability for any claim relating to an order will not exceed the amount you paid for that order.

11. Events outside our control

We are not liable for any failure or delay in meeting our obligations caused by events beyond our reasonable control, including supply chain disruption, carrier or customs delays, pandemics, strikes or government action.

12. Governing law

These Terms are governed by the laws of England and Wales, and disputes are subject to the jurisdiction of the courts of England and Wales. If you are a consumer living elsewhere, you also keep any protections given to you by the mandatory laws of the country or state where you live.

13. Changes to these Terms

We may update these Terms from time to time. Changes apply to future orders only and do not affect orders already placed.
